1. Introduction

Digital Solutions USA LLC (“Digital Solutions USA,” “the Company,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what personal information we collect when you visit https://digital-solutionllc.com (the “Site”) or engage our construction cost estimating and pre-construction consulting services (the “Services”), how we use and share that information, how long we keep it, how we protect it, and what rights you have over it.

Digital Solutions USA LLC is a limited liability company organized under the laws of the State of Maryland, United States, with its principal place of business at 6805 Fallard Pl, Frederick, MD 21703, USA.

We are the controller of the personal information described in this Policy, meaning we decide why and how it is processed.

Please read this Policy alongside our Terms and Conditions and our Cookie Policy.

If you do not agree with this Policy, please do not use the Site or submit information to us.

2. Scope

This Policy applies to personal information we collect:

  • Through the Site, including contact forms, quote request forms, file uploads, and newsletter sign-up
  • Through direct communication with us by email, telephone, or messaging
  • In the course of providing Services to clients
  • Through our advertising and analytics activity
  • From third-party sources as described in Section 4

This Policy does not apply to:

  • Third-party websites we link to, which have their own privacy policies
  • Payment information you enter directly into a third-party payment provider’s secure environment, which is governed by that provider’s own privacy policy
  • Employment applications, handled under a separate notice
  • Information about our own employees and contractors

3. Information We Collect Directly From You

3.1 Contact and Identity Information

When you submit an enquiry, request a quote, or engage us, we collect:

  • Full name
  • Email address
  • Telephone number
  • Company or organisation name and your role
  • Mailing or billing address
  • Any other information you choose to include in your message

3.2 Project Information

To prepare an estimate, we necessarily receive detailed project information, which may include:

  • Project address or job site location
  • Architectural, structural, mechanical, electrical, and plumbing drawings
  • Specifications, finish schedules, scopes of work, and addenda
  • Site photographs and survey data
  • Existing budgets, contractor quotations, and subcontractor pricing
  • Permit documents and approvals
  • Project programme and phasing information
  • Correspondence about scope, assumptions, and preferences

Note on third-party information: Project documents you send us may contain the names, contact details, and signatures of architects, engineers, contractors, consultants, property owners, and others. By sending us these documents you confirm you have the right to do so. We treat all such information as confidential and process it only to deliver your estimate.

3.3 Transaction and Billing Records

  • Invoice records, amounts, dates, and descriptions of Services
  • Payment status, payment method type, and payment date
  • Billing name, billing address, and billing postal code
  • The last four digits and brand of any card used, where our provider supplies this for reconciliation
  • Records of refunds, credits, and disputes

3.4 What We Do Not Collect

We do not collect, process, transmit, or store:

  • Full payment card numbers
  • Card expiry dates or security codes (CVV/CVC)
  • Bank account numbers, routing numbers, or online banking credentials
  • Account balances, credit reports, credit scores, or credit history
  • Income information, tax returns, or financial statements
  • Social Security numbers or taxpayer identification numbers
  • Driver’s licence numbers, passport numbers, or other government identification numbers

All payment card and bank account information is entered by you directly into secure, encrypted, PCI-DSS-compliant payment environments operated by independent payment service providers. That information does not pass through, and is not retained on, our systems at any point.

We have no business need for your wider financial information and we do not ask for it. If you believe you have sent us any of the categories listed above, please tell us so we can delete it.

3.5 Communications

We retain copies of emails, form submissions, and written correspondence with you. We do not record telephone calls unless we tell you in advance and obtain any consent required by the law applicable to your location.

3.6 Marketing Preferences

If you subscribe to our newsletter or opt in to marketing, we record your email address, the date and method of opt-in, and your subsequent preferences.

4. Information We Collect Automatically and From Third Parties

4.1 Technical and Usage Data

When you visit the Site, we and our service providers automatically collect:

  • IP address, which may be truncated or anonymised
  • Browser type and version
  • Operating system and device type
  • Screen resolution and device settings
  • Referring URL and exit pages
  • Pages viewed, time on page, and scroll depth

4.2 Advertising Data

We advertise through paid search. When you arrive from an advertisement, our advertising partners may associate your visit with the campaign, keyword, ad group, and click identifier that brought you here, and may set identifiers used for conversion measurement and remarketing.

4.3 Information From Third-Party Sources

We may receive information about you from:

  • Payment service providers — transaction confirmations, payment status, dispute notifications, and limited billing data
  • Public and commercial business registries — to verify a business client’s registration and standing
  • Your own colleagues — where someone at your organisation refers you or copies you into correspondence
  • Publicly available sources — such as a company website or professional profile, where we are verifying a business enquiry
  • Fraud prevention and security services — signals used to detect fraudulent transactions or attacks against the Site

5.1 What We Do Not Do

  • We do not sell your personal information. We have not sold personal information in the preceding twelve months and have no plans to do so.
  • We do not share your personal information for cross-context behavioural advertising in exchange for money. Certain advertising and analytics cookies may nonetheless constitute a “sale” or “sharing” under some state privacy laws even without payment. Where that is the case, you may opt out as described in Section 11 and through our cookie banner.
  • We do not use your project documents, drawings, or deliverables to train third-party artificial intelligence models.
  • We do not rent, trade, or disclose client lists to third parties for their own marketing purposes.
  • We do not perform credit checks or financial background screening on our clients.
  • We do not knowingly collect information from children. See Section 13.

6. How We Share Your Information

We disclose personal information only as set out below. Every service provider we use is bound by contract to process data only on our instructions and to maintain appropriate security.

6.1 Payment Service Providers

We use independent, industry-standard payment service providers to issue invoices and process payments. When you pay an invoice, you enter your card or bank details directly into that provider’s own secure, encrypted, PCI-DSS-compliant environment.

  • We share with the provider only what is necessary to raise the invoice: your name, email address, the invoice amount, and a description of the Services
  • We receive back only confirmation data: transaction status, amount, date, payment method type, and where supplied, the last four digits of the card and the billing postal code
  • We never receive or store your full card number, security code, or bank credentials

Each payment service provider acts as an independent controller of the payment data it collects, and its handling of that data is governed by its own privacy policy, which is made available to you at the point of payment.

6.2 Website Hosting and Infrastructure

Our web host stores the Site’s files and database, including form submissions, on secure servers located in the United States.

6.3 Email and Communications

We use commercial email services to send and receive business correspondence, deliver invoices and files, and send newsletters where you have opted in.

6.4 File Transfer and Cloud Storage

Because drawings and deliverables are frequently too large for email, we use secure cloud file transfer and storage services to receive Client Materials and deliver completed estimates. Access is restricted and links may be time-limited.

6.5 Analytics

We use website analytics services to understand aggregate traffic patterns and improve the Site.

6.6 Advertising

We use paid search advertising platforms, which process click and conversion data to measure campaign performance.

6.7 Professional Advisors

We may disclose information to our accountants, bookkeepers, auditors, insurers, and attorneys where necessary for them to advise us, and where they are bound by professional confidentiality obligations.

6.8 Subcontracted Estimators

Where we engage a subcontracted estimator or specialist consultant to assist with an engagement, we share only the project materials necessary for that work. Every such person is bound by a written confidentiality agreement.

6.9 Legal and Regulatory Disclosure

We may disclose information where we believe in good faith that disclosure is necessary to:

  • Comply with applicable law, regulation, subpoena, court order, or lawful government request
  • Enforce our Terms and Conditions
  • Investigate or prevent suspected fraud, security incidents, or illegal activity
  • Protect the rights, property, or safety of the Company, our clients, or the public
  • Establish, exercise, or defend a legal claim, including responding to a payment dispute

6.10 Business Transfers

If the Company is involved in a merger, acquisition, financing, reorganisation, bankruptcy, or sale of all or part of its assets, personal information may be transferred as part of that transaction. We will require the recipient to honour the commitments in this Policy and will notify affected individuals where required by law.

6.11 With Your Direction

We will share information with any third party you direct us to, for example sending your estimate directly to your lender, architect, or general contractor at your request.

7. International Transfers

We are based in the United States and our service providers are principally located in the United States. If you access the Site or engage our Services from outside the United States, your information will be transferred to, stored in, and processed in the United States, where data protection laws differ from those of your home country.

Where personal information of individuals in the European Economic Area or the United Kingdom is transferred to the United States, we rely on appropriate safeguards, including the European Commission’s Standard Contractual Clauses with our processors where applicable.

8. Cookies and Similar Technologies

The Site uses cookies, pixels, local storage, and similar technologies, in the categories of strictly necessary, functional, analytics, and advertising.

Where required by applicable law, non-essential cookies are set only after you give consent through our cookie banner. You may change or withdraw your preferences at any time through the banner or the cookie settings link in the Site footer.

8.1 Do Not Track and Global Privacy Control

There is no industry-accepted standard for responding to “Do Not Track” browser signals, and the Site does not currently respond to them.

We do recognise and honour the Global Privacy Control (GPC) signal. Where your browser or extension transmits GPC, we treat it as a valid request to opt out of the sale or sharing of personal information and of targeted advertising, to the extent required by applicable state law.

At the end of the applicable period, information is securely deleted or irreversibly anonymised. Where deletion is not immediately possible, for example data held in encrypted backups, we isolate it from further processing until deletion occurs in the normal backup cycle.

We may retain information beyond these periods where it is subject to a legal hold, an active or anticipated legal claim, a regulatory investigation, or an unresolved payment dispute.

10. How We Protect Your Information

We maintain administrative, technical, and physical safeguards appropriate to the sensitivity of the information we hold:

  • Encryption in transit — the Site is served over HTTPS with a valid TLS certificate; file transfers use encrypted connections
  • Encryption at rest — client files and databases are stored on encrypted storage
  • Access control — access to client materials is limited to personnel who need it, on a least-privilege basis
  • Authentication — strong, unique passwords and multi-factor authentication on business-critical accounts
  • Payment isolation — no cardholder data or bank credentials ever enter our systems; payment handling is fully delegated to PCI-DSS-compliant providers
  • Data minimisation — we do not request or retain financial or identification data we do not need
  • Confidentiality agreements — with every employee, contractor, and subcontracted estimator
  • Software maintenance — regular security updates to the website platform, theme, and plugins
  • Monitoring — security plugins, firewalling, and login protection
  • Backups — regular encrypted backups held separately from production systems

No method of transmission or storage is completely secure. While we work hard to protect your information, we cannot guarantee absolute security, and you transmit information to us at your own risk. Please do not send sensitive personal information such as Social Security numbers, driver’s licence numbers, financial account numbers, or health information through the Site’s contact form or by unencrypted email. We do not require any of that information to prepare an estimate.

10.1 Breach Notification

In the event of a data breach affecting your personal information, we will notify affected individuals and the appropriate regulators as required by applicable law, including the Maryland Personal Information Protection Act and other applicable state breach notification statutes, without unreasonable delay.

11. Your Privacy Rights

Depending on where you live, you may have some or all of the rights below. We extend the core rights of access, correction, deletion, and opt-out to all users regardless of location, as a matter of policy.

11.1 The Rights

  • Right to know / access — confirmation of whether we process your personal information, a copy of it, and details of the categories collected, the sources, the purposes, and the categories of recipients
  • Right to correct — have inaccurate personal information corrected
  • Right to delete — request deletion, subject to the exceptions in Section 11.4
  • Right to portability — receive your personal information in a portable, machine-readable format
  • Right to opt out of sale or sharing for cross-context behavioural advertising
  • Right to opt out of targeted advertising
  • Right to opt out of profiling in furtherance of decisions producing legal or similarly significant effects (we do not conduct such profiling)
  • Right to limit use of sensitive personal information (we do not collect sensitive personal information for the purposes that would trigger this right)
  • Right to withdraw consent at any time, without affecting the lawfulness of prior processing
  • Right to object to processing based on legitimate interests
  • Right to restrict processing in certain circumstances
  • Right to non-discrimination — we will not deny you services, charge a different price, or provide lesser quality because you exercised a privacy right
  • Right to appeal a refusal, as described in Section 11.5
  • Right to lodge a complaint with a supervisory authority or attorney general

11.2 State-Specific Notes

Maryland residents: The Maryland Online Data Privacy Act provides rights to access, correct, delete, and obtain a copy of personal data, and to opt out of targeted advertising, the sale of personal data, and certain profiling.

California residents: The CCPA, as amended by the CPRA, provides the rights above, including the right to know the specific pieces of personal information collected, the categories of sources, the business purposes for collection, and the categories of third parties to whom information is disclosed. In the preceding twelve months we have collected the following CCPA categories: identifiers; customer records information; commercial information; internet and network activity information; approximate geolocation data; and professional or employment-related information. We have not sold personal information. An authorised agent may submit a request on your behalf with proof of authorisation.

Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws: You have the rights described above to the extent provided by your state’s law, including the right to appeal.

Nevada residents: You may direct us not to sell certain covered information. We do not sell such information.

EEA and UK residents: Where the GDPR or UK GDPR applies, you have the rights above and the right to lodge a complaint with your national supervisory authority or, in the UK, the Information Commissioner’s Office.

11.3 How to Exercise Your Rights

Please tell us:

  1. Which right you wish to exercise
  2. Your full name and the email address or telephone number you used with us
  3. Enough detail for us to locate your records

Verification: To protect your information, we will verify your identity before acting. For most requests we will ask you to confirm details already in our records. We will not collect additional identifying documents solely to verify a request unless we cannot verify you any other way.

Timing: We respond within forty-five (45) days. Where a request is complex or numerous, we may extend by a further forty-five (45) days and will tell you within the initial period. GDPR requests are answered within one (1) month, extendable by two further months where necessary.

Cost: Requests are free. We may charge a reasonable fee, or decline, where a request is manifestly unfounded, excessive, or repetitive.

11.4 Limits on Deletion

We may decline a deletion request, in whole or in part, where we need to retain information to:

  • Complete a transaction or provide a service you requested
  • Comply with a legal obligation, including tax and accounting record-keeping
  • Establish, exercise, or defend a legal claim
  • Defend against a payment dispute
  • Detect or prevent fraud or security incidents
  • Maintain the integrity of professional records relating to a delivered estimate

Where we decline, we will tell you why and will delete anything not covered by the exception.

11.5 Appeals

If we refuse a request, you may appeal by replying to our decision with the word “Appeal” in the subject line, or by writing to the postal address above. We will review and respond in writing within sixty (60) days, explaining our reasoning. If we deny the appeal, we will tell you how to contact your state attorney general to submit a complaint.

11.6 Opting Out of Marketing

Click “unsubscribe” in any marketing email, or email us. Opting out of marketing does not stop transactional communications about an active engagement — invoices, deliverables, and project correspondence.

12. Automated Decision-Making

We do not use automated decision-making or profiling that produces legal or similarly significant effects concerning you. Our estimates are prepared and reviewed by human estimators. Where software is used for quantity takeoff and calculation, all output is reviewed by a person before it is issued.

13. Children’s Privacy

The Site and the Services are directed to businesses and adults. We do not knowingly collect personal information from anyone under eighteen (18) years of age, and we do not knowingly sell or share the personal information of anyone under sixteen (16).

If you believe a child has provided us with personal information, contact us at info@digital-solutionllc.com and we will delete it promptly.

14. Third-Party Websites and Services

The Site links to third-party websites, including payment provider pages and potentially social media platforms and map services. This Policy does not apply to those sites. We do not control and are not responsible for their privacy practices. Review the privacy policy of any third-party site before providing information to it.

15. Your Responsibilities

If you send us project documents, please:

  • Ensure you have the right to share them with us
  • Redact any personal information not necessary for the estimate. We do not need Social Security numbers, financial account numbers, health information, or copies of identity documents to price a construction project
  • Tell us if a document is subject to a confidentiality or non-disclosure agreement, so we can handle it appropriately

If you provide us with personal information about another individual — a colleague, a property owner, a design professional — you confirm you are entitled to do so and, where required, that they have been informed of this Policy.

16. Changes to This Policy

We may update this Policy to reflect changes in our practices, our technology, or the law. When we do:

  • We will post the revised Policy here and update the “Last Updated” date
  • For material changes, such as a new category of information collected, a new purpose, or a new category of recipient, we will provide prominent notice on the Site and, where we hold your email address and the change affects you, notify you by email
  • Where a change requires your consent under applicable law, we will obtain it before applying the change to you

Continued use of the Site or the Services after the effective date constitutes acceptance. Please review this page periodically.
